Terms of Service

These Terms govern access to TherapyTrack. By creating an account, accepting an invitation, purchasing a subscription, or using the service, you agree to them.
TherapyTrack supports documentation workflows. It does not provide legal, medical, or clinical advice, and AI-assisted text is never a substitute for qualified review.
1. Eligibility and authority
In these Terms, “TherapyTrack,” “we,” and “us” mean THERAPYTRACK LLC.
You must be at least 18 years old and legally able to enter a contract. The service is intended for credentialed or supervised school-based occupational therapy professionals and other personnel authorized by their organization. Students may not create accounts.
If you use TherapyTrack for a school, district, agency, practice, or other organization, you represent that you are authorized to accept these Terms for that organization and to enter the information you submit. Your organization is responsible for determining whether TherapyTrack is approved for use with student data.
2. Accounts and acceptable use
You must provide accurate account information, protect your sign-in method, and promptly report suspected unauthorized access. You may use TherapyTrack only for lawful professional purposes and within the permissions granted to you.
You may not share credentials; attempt to bypass access controls; access a student without authorization; reverse engineer or disrupt the service; introduce malicious code; use outputs to train or benchmark a competing model without permission; or upload content you do not have the right to process.
3. Solo and Supervisor responsibilities
Solo workspaces
The workspace owner controls its records and is responsible for user activity, lawful student-data authorization, data accuracy, exports, retention decisions, and compliance with employer or district requirements.
Supervisor workspaces
The supervising OT controls invitations, OTA access, student assignments, and permissions. The supervisor is responsible for maintaining appropriate supervision, reviewing collaborator documentation, removing access promptly when it is no longer needed, and ensuring the team follows applicable professional, district, and legal requirements.
Collaborators must use only the students and functions assigned to them. When collaborator access ends, records created within the owner’s workspace remain with that workspace for continuity and recordkeeping, subject to the organization’s instructions and applicable law.
4. Student data and customer content
You and your organization retain ownership of the information you submit (“Customer Content”). You grant TherapyTrack a limited right to host, process, transmit, and display Customer Content only as needed to provide, secure, support, and improve the operation of the service, comply with law, and follow your authorized instructions.
You are responsible for obtaining required approvals, consents, and rights; using the minimum student information reasonably needed; configuring access appropriately; and responding to record requests through your organization. Our Privacy Policy explains our data practices. A signed district DPA controls if it conflicts with these general Terms regarding student data.
5. IEP Assist and AI outputs
IEP Assist and other AI features produce editable drafts from information selected for a request. Outputs may contain errors, omissions, bias, or language that does not fit a student, jurisdiction, or professional standard. TherapyTrack does not warrant that an output is accurate, complete, compliant, or suitable for an IEP or other official record.
You are solely responsible for reviewing and revising outputs, applying independent clinical judgment, obtaining required supervisory approval, and deciding whether an output should be used. Do not rely on TherapyTrack for diagnosis, emergency decisions, legal conclusions, eligibility determinations, or autonomous educational or clinical decisions. See our AI Use Policy.
6. Trials, subscriptions, and billing
- Eligible new workspace owners may receive one 14-day trial. Invited collaborators do not receive a separate trial for the workspace they join.
- Current plan features and prices appear during checkout. Taxes may apply. Stripe processes payments and stores payment credentials.
- The founders offer is limited to the first 50 eligible annual subscription redemptions. Eligible subscribers receive the founders annual price shown at checkout for renewals of that subscription. The offer is not available for monthly plans, is non-transferable, and may be withdrawn before redemption where permitted by law.
- If you add a payment method, a paid subscription begins when the trial ends and renews monthly or annually until canceled. If no payment method is present when required, access may end automatically.
- You may cancel through billing settings. Cancellation generally takes effect at the end of the current paid billing period; fees already paid are non-refundable except where law requires otherwise.
- We may change prices prospectively with reasonable notice. Seat changes and plan upgrades may result in prorated charges disclosed through the billing flow.
7. Service changes and suspension
We may modify features, impose reasonable usage limits, or discontinue parts of the service. We may suspend or terminate access for nonpayment, security risk, unlawful use, material breach, or to protect students, customers, or the service. Where practical, we will provide notice and an opportunity to export data.
You may stop using TherapyTrack at any time. After termination, data handling follows the Privacy Policy and any applicable DPA.
8. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERAPYTRACK IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ERROR-FREE OUTPUTS, OR THAT USE OF THE SERVICE ALONE WILL SATISFY FERPA, IDEA, STATE STUDENT-PRIVACY LAW, LICENSURE RULES, OR DISTRICT POLICY.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.
THERAPYTRACK’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID OR PAYABLE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100. THESE LIMITS DO NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED.
10. General terms
You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets. If one provision is unenforceable, the remainder stays effective. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, order details, and any DPA or separately signed agreement form the agreement for the service; a separately signed agreement controls where it conflicts.
These Terms are governed by the laws of Tennessee, without regard to conflict-of-law rules. Any dispute that may be brought in court must be brought in the state or federal courts located in Knox County, Tennessee, and each party consents to that jurisdiction and venue.
